Terms of service

These terms apply to your use of westernaloha.com and purchases from it. The site is run by Western Aloha Inc., a Delaware corporation ("Western Aloha," "we," "us"). By using the site or placing an order, you agree to these terms. Please read section 12. It requires most disputes to be resolved by individual arbitration, not in court or as a class action, and explains how to opt out.

1. Eligibility and accounts

You must be at least 18, or the age of majority where you live, to buy from us or create an account. You're responsible for keeping your login secure and for activity on your account.

2. Products, colors and sizing

We describe and photograph our products as accurately as we can. Colors may look different on your screen, and prints vary from shirt to shirt because of how fabric is cut. Size and fit guidance is on each product page.

3. Prices, sales and errors

Prices are in US dollars and can change without notice. Taxes and shipping are shown at checkout. When we show a compare-at or "original" price, it is a price at which we offered the item on our site. If a product is listed at a wrong price or with wrong information because of an error, we may cancel the order and refund you, even after we've confirmed it. We'll let you know if this happens.

4. Orders and payment

Your order is an offer to buy. We accept it when we ship it. We may limit quantities or refuse or cancel orders, for example for suspected fraud or resale. Payments are processed by Shopify, PayPal, Amazon Pay or Afterpay under their own terms.

5. Shipping, returns and exchanges

Shipping times and costs are in our Shipping Policy. Returns and exchanges are covered by our Refund Policy. Title and risk of loss pass to you when we hand your order to the carrier.

6. Promotions, gift cards and rewards

Discount codes and promotions have their own terms, can't be combined unless stated, and may end at any time. Gift cards don't expire and can't be redeemed for cash except where the law requires. Our rewards and referral program is run through Smile.io under its program terms.

7. Emails and texts

If you sign up, you agree to receive marketing emails and texts as described at sign-up and in our SMS Terms. You can opt out at any time.

8. Reviews and content you submit

If you post a review, photo or comment, you give us a free, worldwide, non-exclusive license to use, show and share it in connection with our business, including in ads, with your first name and last initial. Don't post anything unlawful, misleading or that infringes someone else's rights. We may remove content at our discretion. We don't pay for or edit reviews to change their meaning.

9. Our content

The site's text, photos, print designs, logos and other content belong to Western Aloha or our licensors. You may not copy, reproduce or sell our print designs or use our trademarks without written permission.

10. Use of the site

Don't misuse the site: no scraping, bots, interfering with security, or using it for anything unlawful.

11. Disclaimers and limits on liability

The site is provided "as is." To the extent the law allows, we disclaim implied warranties other than those that apply to the products you buy, and our total liability for any claim relating to the site or a purchase is limited to the amount you paid for the product involved. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.

12. Disputes

Talk to us first. If you have a problem, email aloha@westernaloha.com. Most issues are solved quickly this way. Please give us 30 days to try to resolve a dispute before starting a formal claim.

Arbitration. You and Western Aloha agree that any dispute, claim or controversy relating to the site, your purchases or these terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and not in court. The Federal Arbitration Act governs this section. The arbitrator decides questions about the scope and enforceability of this section. Arbitration will take place in the county where you live or by video, and we'll pay the filing and arbitrator fees required of a business under those rules.

Exceptions. Either of us may bring an individual claim in small claims court, and either of us may go to court to stop infringement or misuse of intellectual property.

No class actions or jury trials. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective or representative proceeding, and the arbitrator may award relief only to the individual party. You and we waive any right to a jury trial. If 25 or more similar claims are filed by the same or coordinated counsel, they will be administered in batches under the AAA's Mass Arbitration Supplementary Rules.

Opting out. You may opt out of this arbitration agreement by emailing aloha@westernaloha.com with your name, order email and the words "arbitration opt-out" within 30 days after you first accept these terms. Opting out doesn't affect the rest of these terms.

If this section is limited. If the class-action waiver is found unenforceable for a claim, that claim must be decided in court and not in arbitration. Any claim not subject to arbitration will be brought in the state or federal courts located in New Castle County, Delaware, and you and we consent to those courts.

13. Governing law

These terms are governed by the Federal Arbitration Act and the laws of the State of Delaware, without regard to its conflict-of-law rules. This doesn't take away protections you have under the consumer laws of the state where you live.

14. Changes and other terms

We may update these terms by posting a new version here; changes apply to orders placed after the effective date. If any part of these terms is unenforceable, the rest still applies. These terms, together with our Privacy Policy and the other policies linked here, are the entire agreement between you and us about the site.
